Terms of Service

Plotopia is a game that takes real money in and lets real money out. These terms say what that means in practice — including the parts that are inconvenient for us to write down.

Not in force yet

This document is drafted and readable, but it is not in force. Until it is, two things apply independently of it: the purchase terms you confirm inside the game before every deposit, and the payout rules in section 6, which the game follows today. When this document does come into force, you will be asked to accept it — the current confirmation says so, and that is why it says so.

Right now: a free test version

Plotopia is live as a test version, and taking part in it is free. You pay us nothing to play, no deposit is asked of you, and nothing you do inside the game is charged in real money. The Topia you play with during the test is granted to you, not bought.

This matters for how you should read what follows. The sections on buying Topia, deposits, payouts and the right of withdrawal are written for the finished game. While the test runs they describe what will apply — not something that is being charged to you today.

When the game opens for real money, this changes, this note goes, and you are asked to accept these terms before anything can be charged. One thing is real money already and sits deliberately outside the game: the Founder Edition presale, a separate offer with its own terms.

1 · Who we are, and what this is

Your contract is with:

ByteBuzz Creations

"We" and "us" in this document mean the above.

Plotopia is a browser game: a shared city map on which you buy plots, build, staff buildings with citizens, and trade with other players.

Watching costs nothing and needs no account. Playing needs an account, and an account means signing a message with your own crypto wallet — there is no password and no e-mail login.

These terms cover the game. They do not cover the Founder Edition presale, which is a separate offer with its own terms, made before the game opens and not available inside it.

2 · What Topia (TPA) is — and what it is not

Topia is the in-game currency. One TPA corresponds to one USDC, and we hold the USDC that backs the Topia in circulation. You buy Topia by sending USDC (section 4), you spend it inside the game, and you can have unspent Topia paid back out as USDC (section 6).

What Topia is: a balance in our records, held for you, denominated 1:1 in USDC.

What Topia is not, and this list is deliberate:

Prices, yields, fees and building values are game design. We can change them (section 5), and a change can make what you built earn less than it did yesterday.

3 · Your account

4 · Buying Topia

Before every purchase you see the exact terms of that purchase and confirm them. That confirmation is recorded together with the version and a checksum of the text you were shown, so that later there is no argument about what you agreed to.

5 · Playing, fees and changes to the game

Inside the game, Topia pays for plots, buildings, upgrades, collecting your production and trading with other players. Fees apply to some of those actions; the current rate is shown before you confirm the action, and it comes from the server rather than from a printed table, so what you see is what is charged.

Part of the fees flows into the Global Fund, which pays out to players who hold offices in the world. That is a game mechanic and not a yield: what it pays depends on what the world does.

A fee you cannot pay becomes a debt, not a refusal. If your balance does not cover the fee for an action you have already taken, the action still completes and the remainder is recorded as owed. Until it is settled you cannot sell on the marketplace, and the amount is subtracted from what you can pay out (section 6). It is not interest and it does not grow — it is the fee itself, waiting.

We develop the game, and that includes rebalancing it: prices, production rates, staffing rules, fees and building values can change, and they have changed before. Where a change takes effect from a coming cycle rather than immediately, the game says so. What it will never do is take Topia out of your balance to correct a past cycle in our favour.

6 · Paying Topia back out

Unspent Topia can be paid back out as USDC, one for one. Topia you have already spent in the game cannot — spending it is what you bought it for, and what you got for it stays in the game.

Topia committed to an open buy order is not in your balance. When you place an order for resources, the amount it needs is set aside at that moment and is not available for a payout. Cancel the order and it comes straight back; it is not a fee and it is not lost. We say it here because "unspent" would otherwise sound like it includes it.

Only to your own wallet. A payout goes to the address you are signed in with and to no other; there is no field to type a different one. That is not a restriction we could relax on request: a freely chosen destination is the shortest path from a stolen session to somebody else's money.

Every payout request is signed with your wallet, and the message you sign names the amount and the destination in plain text before you sign it.

What you can request

The amount available for a payout is your balance, minus two things: deposits still inside the seven days below, and any fee you still owe (section 5). Topia committed to an open buy order is not part of the balance to begin with. The game shows the resulting figure; it never lets you request more and then fails quietly.

The waiting periods

What happens after that

When we hold a payout back

We refuse or delay a payout only where we have to: a concrete suspicion of fraud, a compromised account, a legal obligation, or a technical fault that makes paying out unsafe at that moment. You are told which of those it is, in substance and not as a code, and a hold ends as soon as its reason does.

7 · Ending the account

You can stop playing at any time, and you can ask us to close your account. Before you do, pay out what you want to keep: closing does not sell your buildings, and it does not convert what you spent back into Topia.

We can close an account for a serious breach of section 3 — an attack on the service, unlawful use, or a repeated attempt to exploit a defect after being told. In that case unspent Topia is still paid out to you under section 6; we do not keep balances as a punishment. What we withhold, and only then, is what was obtained through the breach itself.

What happens to your data afterwards is in the Privacy Policy, section 8 — including the records we are required to keep even after a deletion request.

8 · Availability and changes to these terms

Plotopia is one server run by one person. It will be down sometimes, for updates and for faults, and we do not promise a level of availability. What we do promise is that an outage does not cost you what you own: the world state is saved continuously and backed up before risky operations.

If these terms change materially, we ask you to accept the new version in the game rather than treating your silence as agreement. Small corrections — a clearer sentence, a typo — take effect when they are published, and the date at the bottom of this page changes with them.

9 · Liability

We are liable without limitation for intent and gross negligence, and for damage to life, body or health. For simple negligence we are liable only where we breach an obligation whose fulfilment is essential to using Plotopia at all, and then only for the damage typically foreseeable in this kind of contract. Your statutory rights as a consumer are not affected by any of this.

We are not liable for what we cannot reach: losses in your own wallet, a lost or stolen key, a transfer sent on the wrong network or to the wrong address, the behaviour of the blockchain itself, or the acts of other players.

10 · Applicable law and disputes

If you are a consumer, the mandatory consumer protection of the country you live in applies to you, and nothing in these terms takes it away.

We do not take part in proceedings before a consumer arbitration body. A complaint reaches a person directly through our Contact page, and it is answered.

11 · Right of withdrawal

This section is about buying Topia — the one place in Plotopia where you pay real money. Buying a plot or a building inside the game is a move in the game, not a new purchase from us.

What normally happens, so you can read the rest in order

Before every purchase you are asked to tick two boxes: that we should start immediately, and that you understand this ends your right of withdrawal for that purchase. If you tick them and we credit your Topia, that right is gone — so for a completed purchase there is normally nothing left to withdraw. That is the rule, not the exception, and the boxes are how you choose it.

What that costs you is smaller than it sounds, and the box further down says why: the way back to your money does not run through the right of withdrawal. It runs through a payout, and that stays open.

The right still matters in two cases, and both are real: you declined the boxes, or something went wrong with the purchase itself. The instructions below are written for those.

Instructions on withdrawal

You have the right to withdraw from your purchase of Topia within 14 days without giving any reason. The period begins on the day the contract is concluded, which is when we credit the Topia to your balance.

To withdraw, tell us clearly that you do: a message through our Contact page is enough, and it does not have to use any particular wording. Sending it before the 14 days are over is enough to be in time.

If you withdraw, we refund the USDC you paid for that purchase, without undue delay and at the latest within 14 days of your notice, to the wallet you paid from.

When the right ends early

Topia is digital content that we deliver immediately. Before every purchase you are asked to confirm two things, separately and unticked:

If you confirm both and we then credit the Topia, your right of withdrawal for that purchase is gone. We record that confirmation with a checksum of the exact text you were shown, so it can be produced later.

You can decline. Nothing then happens automatically: your payment is held and not credited until you confirm. Because the contract is concluded by the crediting, a payment that was never credited is not a purchase you need to withdraw from — it is money of yours that we are holding. Ask and you get it back, to the address it came from, and you do not have to give a reason or meet a deadline for it.

How a refund is actually carried out

By a person, not by a button: there is no self-service route for it. Write to us through our Contact page and it is done by hand.

And it is booked. A refund appears in your account history as its own entry, like every other movement of money in Plotopia, and the transfer that carries it out is matched against that entry. There is no such thing here as a quiet transfer that no record knows about — our own books would not close if there were, and the server refuses to start when they do not. We mention it because it is the difference between a promise and a property of the system.

Losing the withdrawal right does not lock your money in

This is the sentence that matters, and it is the same one the game shows you before every purchase: your right of withdrawal is a right to undo a purchase. It is not the way you get your money back. That way stays open either way — unspent Topia can be paid back out to the wallet you paid from, under section 6, with no time limit on when you ask.

What withdrawal would give you and a payout would not: the 7-day period after a deposit does not apply to a refund on withdrawal, and neither do the payout limits. That is the whole difference.
